Hello and welcome to WayGiver Christian Crowdfunding. Not many people read a company's Terms of Use so I wanted to personally thank you for taking the time. Who We Are

WayGiver LLC owns and operates the Christian crowdfunding platform WayGiver.com. Our mailing address is 2415 Airport Road, Johnson City, NY 13790. You can contact us at HereToHelp@waygiver.com.

 

What We Do

At WayGiver, our mission is to provide a place for individuals, churches, and Christian ministries (the Christian Church) to create an online crowdfunding campaign page and to give donors the opportunity to reflect God's love through giving. Our service is for campaigns that align with our mission and market segment. All campaigns will be reviewed and approved by WayGiver before being made public.

 

Here are some of the fundraiser types we will host:

  • Mission trips
  • Medical support
  • Religious Freedom
  • Pastor Sabbaticals
  • Emergencies
  • Memorials
  • Educational
  • Adoptions (through WayGiver approved adoption agencies only)
  • Wedding related (through WayGiver partner churches only)
 

This is not an exhaustive list. If you have a fundraiser idea and would like to run it by the WayGiver staff, please email us at HereToHelp@waygiver.com.

 

Here are some of the fundraiser types we will not host:

  • Abortions
  • Elective medical surgeries

Definitions

These terms shall have the following meaning throughout this Terms of Use Agreement.

  1. "Agreement" or "this agreement" refers to these Terms of Use.

  2. "Applicable law" refers to the laws currently in force in the State of New York, Broome County, USA which shall govern this agreement.

  3. "Site" means this website, WayGiver.com, all related webpages, and all related websites operated by WayGiver, but does not include any third party websites which are linked to or may link from this website whether or not such third party websites are used in connection with the Services.

  4. "Service" and "Services" refer to the crowdfunding fundraising pages we host, our support, and our educational content.

  5. "User" refers to any person who utilizes our Services or has any interaction with our Site.

  6. "Fundraiser Organizer" or "Campaign Organizer" refers to any person who opens an account with WayGiver in order to create a fundraising page or campaign.

  7. "WayGiver", "we", "us" shall refer to WayGiver LLC.

  8. "You" and "user" shall refer to any person who visits the Site, or any person who views or downloads any materials, any person who interacts with the Site by leaving a message or giving a donation, or uses the WayGiver.com to conduct a fundraising campaign and their employees and agents.

 

General Use

If you interact with or use WayGiver.com, you are agreeing to be bound by these Terms of Use without any modification or qualification. IF YOU ARE DISSATISFIED WITH THE TERMS, CONDITIONS, RULES, POLICIES, GUIDELINES OR PRACTICES OF OPERATING OUR SERVICE, UNLESS EXPRESSLY SET OUT IN THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SERVICE. If for any reason you are unable to meet all the conditions set forth under this agreement, or if you breach any of the Terms of Use contained herein, your permission to use the Site is discontinued and you must destroy any materials downloaded or printed from the Site.

 

Changes to Terms

WayGiver reserves the right to modify or change these Terms of Use at any time without giving prior notice. We shall, however, notify you of significant changes by posting an announcement on the Site. Your use of WayGiver.com is subject to the most current Terms of Use posted on the Site at such time. The most current version can be reviewed by clicking "Terms of Use" hyperlink at the bottom of our Site pages.

 

Who Can Use our Service

Anyone can use our Service. WayGiver does not discriminate against people. However, we only approve and publish campaigns related to our mission and market segment. If you have any questions, please contact us at HereToHelp@WayGiver.com. As the email address says, we are here and help and do our best to assist you even if you don't end up using our Service.

 

Third Party Services

WayGiver.com uses Stripe to handle our credit card processing. Because their service is critical to our operation, you should take the time and view Stripe's Terms of Service also.

 

Our Fees

It is free to set up a campaign on WayGiver.com. We only charge a fee when a donation is made and here is how that happens.

 

There are two parts to the fee we charge. First is the credit card processing charged by Stripe to handle all financial transactions. The credit card processing fee is typically 2.9% + $0.30 per transaction. This is the same fee charged by most other donation-based crowdfunding sites. Second is the platform fee, which WayGiver charges to keep the website going, lights on in the office, and our staff paid. It is also the same or lower than other donation-based crowdfunding sites. We charge this fee on all donations.

 

We have setup our Site so that each donor is asked if they would like to cover the fees as part of their donation. A very high percentage of donors choose that option which means that the entire donation goes to the campaign. That typically increases the total amount of the campaign by nearly 8%.

 

One of WayGiver's core values is "Giving Back." WayGiver gives back 10% of our platform fee to ministries and campaigns that move and inspire us because we also want to reflect God's love by giving.

User Content on Website

You are solely responsible for the content you post on the Site including but not limited to photos, text, videos, graphics, and personal profiles. Information, ideas or opinions posted by users of the Site do not necessarily reflect our views and WayGiver does not take any responsibility for the accuracy of any information, ideas or opinions posted by Users. WayGiver shall not be liable for any damages or losses resulting from such information, ideas or opinions. As a User, you understand and agree that WayGiver may terminate any campaign, user account or access to use the Site at any time and for any reason. By posting any information or other content on the Site, you have authorized WayGiver to publish such materials in any manner desired without any obligation to compensate you or anyone else.

 

You further understand and agree that WayGiver may monitor, edit, and delete any content that we, in our sole and absolute discretion, believe violates the terms of the this User Agreement or which may be illegal or offensive, or which poses a threat to the rights or safety of WayGIver Users. Minor grammatical or formatting changes done by WayGiver are a customer service in order to keep your campaign and our Site as professional as possible.

 

Offensive Use or Content

User agrees to NOT to upload or display any content that contains nudity, sexually graphic content, drug use (implied or literal), or material that is otherwise deemed explicit, or in poor taste by WayGiver; or content that contains threatening, abusive, harassing, defamatory, libelous, invasive, hateful, or racially, religiously, ethnically or otherwise objectionable. Further, the User agrees NOT to use WayGiver to raise donations, create fundraisers for any organization or event involved in the above. Doing so will result in removal of your campaigns(s) and immediate termination of your account. WayGiver reserves the right to refuse service to any campaign it deems to be in poor taste or opposed to the mission of our Service.

 

Limitation of Warranty

All SERVICES ARE PROVIDED "AS IS" AND WITHOUT ANY WARRANTY, EXPRESS, IMPLIED OR OTHERWISE, REGARDING SUCH SCOPE OF WORK OR SERVICES' ACCURACY, PERFORMANCE, OR ANY OTHER MATTER. WAYGIVER DOES NOT WARRANT THAT THE WEBSITE IS WITHOUT ERROR OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE IN ITS OPERATION OR THAT IT WILL SATISFY USER'S REQUIREMENTS. NOTWITHSTANDING ANYTHING HEREIN TO THE CONTRARY, WAYGIVER HEREBY DISCLAIMS ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT OF THIRD-PARTY RIGHTS. WAYGIVER MAKES NO WARRANTY, REPRESENTATION OR PROMISE NOT EXPRESSLY SET FORTH IN THIS AGREEMENT.

 

Limitation of Liability

WAYGIVER'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THIS AGREEMENT, FOR ANY AND ALL DAMAGES THAT YOU MIGHT INCUR (REGARDLESS OF THE FORM OF ACTION GIVING RISE TO SUCH LIABILITY, WHETHER IN CONTRACT, TORT OR OTHERWISE) SHALL NOT EXCEED USERS'S PLATFORM FEES FOR A TWELVE (12) MONTH PERIOD. WITHOUT LIMITATION OF THE FOREGOING, WAYGIVER SHALL NOT (A) HAVE ANY LIABILITY TO USER FOR ANY SPECIAL, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, OR INDIRECT DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, REVENUES, DATA AND/OR USE), REGARDLESS OF THE THEORY OR LIABILITY (INCLUDING TORT, CONTRACT AND NEGLIGENCE), AND EVEN IF ADVISED OF THE POSSIBILITY THEREOF; OR (B) BRING ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT MORE THAN TWELVE (12) MONTHS AFTER THE CAUSE OF ACTION ACCRUES. YOU EXPRESSLY AGREE THAT USE OF WAYGIVER IS AT YOUR SOLE RISK. WAYGIVER IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
